What is Assault?

There are three main factors that determine a criminal assault charge.

1. Assault is when a person intentionally presents an unlawful threat of bodily injury to another person by force.
2. There is a presentation of imminent fear or peril to the victim.
3. It appears that the assailant has the ability to carry out the threat.

Note: It can still be considered an assault in some cases, even if there is no physical contact between the person that is being accused and the apparent victim. A good example is someone pointing a toy pistol at another person from 30 feet away. Even though the pistol is a fake and the defendant has no real ability to inflict harm with the toy pistol from that distance, the supposed victim may not know it and may feel that there is a real threat of bodily injury.
